By accessing or using NBAnalytics AI ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and NBAnalytics AI.

2. Eligibility and Age Requirement

You must be at least 21 years of age to use this Service. By using NBAnalytics AI, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms.

Sports betting is subject to federal, state, and local laws. You are solely responsible for determining whether sports betting is legal in your jurisdiction. NBAnalytics AI does not accept bets or wagers of any kind. We provide sports analytics and informational content only.

3. Service Description

NBAnalytics AI is a sports analytics platform that provides:

• AI-generated NBA game analysis and predictions ("picks")
• Cognitive bias warnings and educational content
• Performance tracking tools
• Historical statistics and analytics

IMPORTANT: NBAnalytics AI is an informational and entertainment service only. We do not operate a sportsbook, accept bets, or facilitate gambling transactions.

4. No Guarantee of Results

You acknowledge that:

• All picks are opinions and analyses, not guaranteed outcomes
• Sports outcomes are inherently unpredictable
• You may lose money if you choose to place bets based on our content
• We are not responsible for any betting decisions you make
• Historical performance statistics are provided for informational purposes only

5. Subscription and Billing

NBAnalytics AI offers subscription-based access to premium features:

• Free Trial: New users may be eligible for a 7-day free trial. Only one free trial is available per user.
• Subscription Fee: $19.99 per month, billed monthly after any applicable trial period.
• Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are provided for partial months.
• Payment Processing: Payments are processed securely through Stripe. By subscribing, you also agree to Stripe's terms of service.

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• Not share your account with others
• Not create multiple accounts to abuse free trials

7. Prohibited Uses

You agree not to:

• Use the Service if you are under 21 years of age
• Resell, redistribute, or commercially exploit our content
• Copy, scrape, or automate access to our data
• Use the Service in jurisdictions where sports betting content is prohibited
• Attempt to circumvent any security features
• Use the Service for any illegal purpose
• Misrepresent your identity or create fraudulent accounts

8. Intellectual Property

All content on NBAnalytics AI, including but not limited to text, graphics, logos, algorithms, analyses, and software, is the property of NBAnalytics AI or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NBANALYTICS AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY BETTING DECISIONS YOU MAKE BASED ON OUR CONTENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless NBAnalytics AI and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, violation of these Terms, or violation of any applicable laws.

12. Responsible Gambling

We encourage responsible gambling practices. If you choose to bet based on information from our Service:

• Only bet what you can afford to lose
• Set limits on time and money spent gambling
• Never chase losses
• Seek help if gambling becomes a problem

13. Modifications to Terms

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that you may bring claims in small claims court if eligible.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
